Russian lawmaker says MH17 tribunal aimed at blaming Moscow alone for crash

The chairman of the Federation Council’s international affairs committee, Konstantin Kosachyov, regards the idea of creating an international tribunal for investigating the loss of Malaysia’s flight MH17 over Ukraine last summer as an attempt to whitewash Ukraine and put the blame for the events in its territory on Russia. 


"That idea pursued a very different, sole aim - that of whitewashing Ukraine, making it immune to responsibility whatever had happened in reality, and making Russia alone responsible for everything that has been happening in Ukraine and to Ukraine. Even if there is no legal or human logic about that. It’s all about geopolitics," Kosachyov writes in his blog on the official website of the upper house of parliament.

Kosachyov believes the very fact that Ukraine was among the co-authors the UN Security Council's draft resolution on the creation of an international tribunal to probe into the causes of the disaster is a clear sign that country has been "guaranteed" a favorable outcome of the still incomplete investigation.

"Extracting one episode from the Ukrainian drama and making it the focal point of a tribunal is a clear attempt at preventing the investigation of all other aspects of the Ukrainian events," Kosachyov said.
He recalled that the cases in which the idea of international UN tribunals had materialized in the past were very few. In all such instances the initiative stemmed from the actual inability of the national judicial system in the countries concerned to administer justice.

"Yesterday’s idea of creating a tribunal by no means corresponds to the UN Charter. The investigation has not been completed yet. No culprits have been identified. And there has been nothing like collapse of the judicial branch of power in Ukraine where the disaster occurred and where justice is to be administered," Kosachyov said.

    The five countries investigating the downing of a Malaysian airliner over Ukraine a year ago are considering setting up an independent international tribunal after Russia vetoed attempts to establish a U.N.-backed court to prosecute suspects.

    Russia deployed its permanent member's veto in the United Nations Security Council on Wednesday, blocking a move to establish an international court.

    Malaysia Airlines Flight MH17 was shot down in July 2014 with 298 passengers on board, two-thirds of them Dutch. It crashed in Ukrainian territory held by Russian-backed separatist forces.

    Ukraine and many Western countries believe the plane was downed by Moscow-backed separatists who had mistaken it for a Ukrainian military aircraft and fired a Russian-made missile at it. No suspects have yet been named.

  3. Moscow sees political subtext in calls by some Western countries and Ukraine to abolish the veto right in the UN's Security Council, Churkin said....

    "We see, of course, some political subtext here, because a lot is subjective about the French proposal," Churkin argued.

    Earlier this year, France renewed its call for a new regulation, which would oblige the permanent members of the UN Security Council to refrain from using a veto in cases where a mass atrocity had been confirmed. The motion was first proposed in 2013.

    "We believe that the veto power of the five permanent members is a very important mechanism, that makes delegations work on reaching consensus," he stated.

    Russia’s Foreign Minister Sergei Lavrov said in August that France was unlikely to be able to push the new regulation through, since the right to veto is unconditional and is enshrined in the UN Charter.
