Hague Court Says Impossible To Establish Actions Of Buk Air Defense System Crew

 The Hague District Court ruled that it is impossible to establish the actions of the crew of the Buk air defense system, which shot down the Malaysian Boeing MH17, and it is also unclear who gave the command to launch the missile, Judge Hendrik Steenhuis said on Thursday.

On Thursday, The Hague District Court will announce the verdict in the case of the crash of the Malaysian Boeing MH17 in eastern Ukraine in 2014. The defendants in the case are Russian citizens Igor Girkin, Sergei Dubinsky, Pulatov, and Ukrainian citizen Igor Kharchenko.

"Based on the case materials, it is impossible to establish how the crew of the Buk air defense system acted when launching the missile on flight MH17, it is also unclear who gave specific instructions for launching the missile and why this happened.

Nevertheless, without these specific details, certain things can be determined regarding the use of the Buk air defense system," Steenhuis said.

The court also believes that all intercepted conversations among the defendants in the MH17 case are credible evidence. Despite the fact that the defendants were not a single group, they were connected to the use of the Buk air defense system, the judge said.

The MH17 flight from Amsterdam to Kuala Lumpur crashed near the city of Donetsk on July 17, 2014. All 298 passengers and crew members were killed.

  1. A Dutch court has sentenced three Russia-linked men and acquitted one for their alleged roles in the downing of Malaysia Airlines flight MH17.

    Former Russian intelligence agents Igor Girkin and Sergey Dubinsky and Ukrainian Leonid Kharchenko, a separatist leader, were found guilty of murder and intentionally causing an aircraft to crash at The Hague District Court on Thursday.

  2. El juez neerlandés Hendrik Steenhuis abrió la audiencia este jueves para dictaminar el veredicto acerca del derribo del vuelo MH17 de Malaysia Airlines que tuvo lugar en 2014 en el este de Ucrania.

    Los ciudadanos rusos Ígor Guírkin y Serguéi Dubínski y el ciudadano ucraniano Leonid Jarchénko han sido declarados culpables de la destrucción de la aeronave y de la muerte de las 298 personas, entre tripulación y pasajeros, que viajaban en el avión.

    Por otra parte, el juez declaró inocente al ciudadano ruso Oleg Pulátov, fallecido en 2021, y rechazó la petición de la Fiscalía de encarcelarlo.

    El tribunal consideró probada la culpabilidad de Guirkin, a la vez que calificó a Jarchenko y Dubinski como cómplices en el lanzamiento del misil que derribó al avión. En el momento de la tragedia, Guirkin ocupaba el cargo del Ministro de Defensa de la República Popular de Donetsk, mientras que Jarchenko y Dubinski ocupaban cargos militares inferiores.

    El tribunal de La Haya condenó a los tres a cadena perpetua. Además, estimó el importe total de la indemnización a los familiares de las víctimas en más de 16 millones de euros.

A Dutch court ruled that full compensation should be paid out to the families of the passengers killed when a Malaysian Airlines Boeing-777 was shot down by a Buk missile over eastern Ukraine in July 2014, judge Hendrik Steenhuis said on Thursday, delivering the court’s verdict in the criminal case on the crash of flight MH17.

    According to the judge, the amount of compensation requested was in line with Ukrainian legislation and the court found it to be justified.

    The full amount of damages awarded by the court surpasses €16 mln.
