Parliament in Ukraine Votes to Give Yanukovych ICC Trial

KIEV, February 25 (RIA Novosti) – Ukraine’s parliament approved a resolution Tuesday to have deposed President Viktor Yanukovych tried at the International Criminal Court for crimes against humanity.

Under the motion, approved by 324 deputies in the 450-seat chamber, top officials who have been linked to the killing of protesters in the period from late November through to last week should face prosecution at the tribunal.


“The main purpose of this resolution is to ensure an independent investigation and punishment of those responsible of crimes against humanity in Ukraine,” according to a note attached to the motion.

    Les députés ukrainiens ont voté, mardi, à une large majorité, le renvoi du président destitué Viktor Ianoukovitch devant le tribunal de La Haye pour "crime grave". Par ailleurs, la situation politique et économique en Ukraine reste précaire.

    Trois jours après la destitution du président Viktor Ianoukovitch par le Parlement ukrainien, les députés ont voté, mardi 25 février, le renvoi de l’ancien chef de l’État devant la Cour pénale internationale (CPI) de La Haye pour "crimes graves".

    Les députés ukrainiens tiennent Viktor Ianoukovitch, mais également l’ex-ministre de l’Intérieur Vitali Zakhartchenko et l'ancien procureur général Viktor Pchonka, pour responsables du bain de sang au cours duquel, la semaine dernière, plusieurs dizaines de manifestants ont été tués.

  2. Ukraine wants runaway president to face international justice....

    (Reuters) - Ukraine's parliament voted on Tuesday to send fugitive President Viktor Yanukovich to be tried by the International Criminal Court for "serious crimes" committed during violent anti-government protests in which scores were killed.

    A resolution, overwhelmingly supported by the assembly, linked Yanukovich, who was ousted on Saturday and is now on the run, to police violence against protesters which it said had led to the deaths of more than 100 citizens from Ukraine and other states.

    After a fortnight of violent clashes in the name of democracy, Ukraine seems to be falling into a totally different trend. Symbols of Soviet unity and victory over Hitler and Napoleon are being torn down, while those glorifying Nazi rule are multiplying.

  4. Creation of a Civil society platform for a democratic Ukraine...

    25 February 2014 witnessed the creation of a Civil society platform composed of non-political Civil society actors from Ukraine, whose goal is a long-term strategy for the democratic development of a European Ukraine.

    Scheduled to be named "Democracy for Ukraine", the platform was launched at a press conference in Strasbourg by Ruslana Lyzhychko, Ukrainian singer and face of the Maidan civil protest movement, and Henri Malosse, president of the European Economic and Social Committee.

    Formed in the aftermath of the Maidan movement, the non-political platform will aim to tackle the mechanisms of corruption in Ukraine, to keep the country united, and to lead the citizens closer to embracing a democratic identity and European values.

    "I have been approached by many devoted, apolitical society leaders, who are ready to volunteer their efforts for the good of their country, including the council of Ukrainian churches", Ruslana Lyzhychko declared that the platform will be composed of employers, trade union representatives, students, intellectuals, artists, and various religious leaders from across Ukraine.

    Henri Malosse, president of the EESC, which represents the civil society of the European Union, engaged to offer its support and expertise, as well as the cooperation of the other European institutions: "the most important action right now is to truly involve Ukrainian citizens in the long-term strategy for eradicating corruption, and stimulating reform and development of their country".

    After meetings with Guy Verhofstadt and Mariella De Sarnez at the European Parliament, Mr Malosse and Ms Lyzhychko also met with the Council of Europe Commissioner for Human Rights, Nils Muiznieks. They discussed the necessity for investigations in the human rights violations in Ukraine in order to bring the people responsible to justice. They agreed that the priorities facing Ukraine include anti-corruption schemes and reforms in the police, prosecution and judiciary systems. "We cannot build democracy on top of blood, as long as the criminals are not punished", Henri Malosse said.

    Arsen Avakov, Verkhovna Rada commissioner for monitoring the activities of Ukraine's Interior Ministry, has signed an order on the disbandment of the Berkut special police unit.

      Ο εκτελών χρέη υπουργού Εσωτερικών της Ουκρανίας Αρσέν Αβάκοφ υπόγραψε διάταγμα για την κατάργηση της μονάδας ειδικών δυνάμεων ασφαλείας Berkut.

    2. Oleksandr Turchynov assumes duties as Ukraine's Commander-in-Chief....Earlier, the Rada vested Turchynov with powers to sign country’s laws....

      Speaker of Ukraine’s parliament Verkhovna Rada Oleksandr Turchynov, who has been appointed interim president of Ukraine, has assumed the duties as Commander-in-Chief of the Armed Forces of Ukraine. A decree to this effect has been signed. “Under Article 106 and Article 112 of the Constitution of Ukraine I enter into duties of commander-in-chief of Ukrainian Armed Forces,” the decree says.

      Earlier, the Rada vested Turchynov with powers to sign country’s laws. The decision to this effect was supported by 316 lawmakers.



      Formation of new government

      Leaders of Ukrainian parliamentary factions Batkivshchyna (Fatherland), Svoboda (Freedom) and Udar (Ukrainian Democratic Alliance for Reform) are holding consultations with activists of protest movement over composition of a new government, Batkivshchyna faction leader Arseniy Yatsenyuk told reporters on Tuesday.

      The faction leader noted that people included in a government “will quit big politics for a long time.” “We realize that it will be difficult to combine professionalism of government and representation of Maidan (protest movement),” the politician said, adding that “the only possible principle of transparency and trust to each other should be chosen.”

      “A future government will face outstanding challenges, and I should say frankly that, on the one hand, members of a new government will save the country, but, on the other hand, they should realize that they commit a political suicide,” Yatsenyuk added.

  6. Demonstrators from Independence Square to be included in Ukraine's new govt...

    Protesters from the Independence Square in the Ukrainian capital will be included in Ukraine's new government, UDAR party member Valery Patskan told Channel 5 in a live broadcast on Tuesday.

    "I have just returned from a Mainda conference. We discussed principles for the formation of a new government. First of all, a decision was made that representatives of the general public would be included in the (new) government. They will head several ministries," the MP said. "Second. UDAR suggested that a public council be formed at each ministry and a public council chairman become Deputy Minister".

    '"It is possible that you (a member of the general public) will not be a specialist in this or that branch but you must be an honest and decent person and succeed in organzing a team of professionals around you," Patskan pointed out.

    An assembly of protesters will take place in Indepdence Square here at 19:00, local time, on Wednesday to suggest composition of a new government of Ukraine.

    Earlier, Ukraine's acting President Alexander Turchinov had reported that the Verkhovna Rada was planning to announce a coalition on Feb. 27 and form a new government.

  7. IMF likely to send technical team to Ukraine soon - Lagarde...

    The International Monetary Fund is likely to send a technical support team to Ukraine soon in order to assist Kiev after its president was toppled by violent street protests over the weekend, IMF chief Christine Lagarde said on Tuesday.

    "We will probably shortly send some technical assistance support to the country," Lagarde, the IMF's managing director, said during an appearance at Stanford University in California. "Because this is our duty to a member if that member asks for that. That is clearly what is likely to happen."

    Ukraine's parliament does not plan to vote on the formation of a government until Feb. 27, and the IMF's rules do not allow it to offer financial support to a country that has not asked for it.

  8. U.S. warns banks to watch for ousted Ukraine leader moving looted funds...

    (Reuters) - The U.S. Treasury warned banks on Tuesday to be on the look-out for potentially suspicious transfers of financial assets by Ukraine's fugitive President Viktor Yanukovich or members of his inner circle.

    Yanukovich is on the run after being toppled by bloody street protests in which police snipers killed demonstrators.

    An advisory from the Treasury's Financial Crimes Enforcement Network (FinCEN) said that U.S. financial institutions "should be aware of the possible impact that public reports of high-level corruption by senior members of the Yanukovich administration and other illicit activity by members of the administration may have on patterns of financial activity".

    FinCEN said it was reminding banks they were required to apply "enhanced scrutiny" to accounts held by Yanukovich or his circle "and to monitor transactions that could potentially represent misappropriated or diverted state assets".

    Ukraine's parliament voted on Tuesday to send Yanukovich to the International Criminal Court over police violence against protesters which it said had led to the deaths of more than 100 citizens of Ukraine and other states.

    The country's new leaders have appealed for urgent international aid, saying it needed $35 billion over the next two years. Acting President Oleksander Turchinov warned that Ukraine was close to default and "heading into the abyss".

  9. Ukraine not able to prosecute Yanukovych through ICC....

    Ukraine cannot appeal to the International Criminal Court (ICC) in the Hague with a request to prosecute former leaders of the country, including President Viktor Yanukovych, representative of the public relations office of the International Criminal Court said.

    "No country in the world has a right to ask the ICC to prosecute certain people," the court's spokesperson noted.

    Moreover, the ICC's jurisdiction does not cover Ukraine at the moment because the country has not yet ratified the Rome Statute of the International Criminal Court.

    "Any country can decide to ratify the Rome Statute, which will give the ICC the opportunity to investigate cases that took place on the territory of the country anytime from July 1, 2002, when the document came into force," the court's spokesperson noted.

  10. Ukraine's Yanukovych put on international wanted list, Russia unaware of his whereabouts....

    Ukrainian ousted President Viktor Yanukovych has been placed on the international wanted list, prosecutor-general Oleh Makhnytsky said on Wednesday. Meanwhile Russian President Vladimir Putin's press secretary Dmitry Peskov said he had no information on the whereabouts of Viktor Yanukovych.

    Ukraine's new authorities say that Yanukovych, who was ousted by parliament on Saturday after three months of street unrest and has gone into hiding, is wanted for 'mass murder' connected with the shooting deaths of protesters during the crisis.

    A decision by the new Ukrainian authorities to put President Viktor Yanukovych on the internationally wanted list arouses serious concern over it compliance with the law. The procedure of declaring a person international wanted stipulates that there has to be irrefutable evidence of the guiltiness of that person, whom a country wants to be detained abroad. It’s doubtful that the newly-appointed Ukrainian officials possess such evidence against Viktor Yanukovych.

    Earlier, Russia made clear that "Yanukovych remains a legitimately elected president and that he has not been ousted". That’s the opinion of Federation Council Speaker Valentina Matviyenko and Chairman of the State Duma Committee on CIS Affairs, European Integration and Ties with Compatriots Leonid Slutsky.

    The Ukrainian Constitution specifies legal procedures that have to be observed in case the Verkhovna Rada votes to dismiss the President, Matviyenko said.

    "First, there has to be an impeachment procedure in the Verkhovna Rada. It then has to be approved by the Constitutional Court and Supreme Court. That hasn’t been done so far," she said.
